The Role of Lawyers in The Judicial System: Responsibilities, Challenges and Strengthening Legal Protection

This study examines the role of advocates in the judicial system as legal protectors, power balancers, and providers of psychological and educational support for clients. Advocates face significant challenges including limited access to clients and evidence during investigation and detention phases, pressure and intimidation from parties with vested interests, and gaps in legal education and training. Legal aid for suspects, defendants, and victims constitutes a fundamental element regulated under Criminal Procedure Code Article 54 and various witness and victim protection laws. Strategic measures required include regulatory reform guaranteeing advocate access to clients and evidence, strengthening legal protection against threats and intimidation with clear reporting mechanisms, and enhancing continuing legal education. Law enforcement institutions require adequate training regarding advocate roles in ensuring fair judicial processes. The state bears constitutional responsibility to guarantee advocate security and independence as main pillars of the rule of law.
