Regulation of Electronic Data and Personal Data in Indonesian Criminal Procedure Law
Abstract
This research analyzes the relationship between electronic data and personal data in law enforcement and examines the harmonization of regulations between the Personal Data Protection Law and the Electronic Information and Transactions Law in the context of seizing electronic evidence. This normative legal research employs statutory and conceptual approaches using primary, secondary, and tertiary legal materials analyzed qualitatively. The findings indicate that electronic data and personal data are closely interconnected in law enforcement, yet pose significant privacy protection challenges, particularly in seizure procedures that often encompass irrelevant information. Fulfilling the authenticity, integrity, and reliability requirements for electronic evidence faces technical and legal obstacles. This research finds that implementing the principles of minimality, transparency, and accountability in seizing electronic evidence is essential to balance law enforcement needs with privacy rights protection. Harmonization among relevant laws still encounters legal gaps, including the lack of specific guidelines, weak oversight, and inadequate sanctions. Standardization of procedures, capacity building for law enforcement officers, and comprehensive technical guidelines are required to create a fair balance in the digital era.
