Land Dispute Resolution through Litigation in the State Administrative Court and the Urgency of Establishing a Special Land Court

This research analyzes the constraints of land dispute resolution through litigation in the State Administrative Court and formulates the urgency of establishing a special land court. The normative juridical approach with descriptive analytical specification was employed through literature study of primary, secondary, and tertiary legal materials. The findings reveal that bureaucratic reform in the State Administrative Court encounters significant obstacles including overlapping authority with the General Court, unclear absolute competence, and weak execution of final and binding decisions. Land disputes arising from infrastructure development and public interest conflicts further complicate the litigation process. The existence of multiple decisions regarding a single land object indicates the need for a special court with its own procedural law. The special land court is expected to adjudicate disputes comprehensively with a single binding and executable decision. Strengthening judicial institutions through the establishment of a special court represents a strategic measure to realize legal certainty, justice, and good governance.
