Law Enforcement in Medical Practice: the Urgency of Licensing, Criminal Sanctions, and the Balance of Legal Protection for Patients and Healthcare Professionals

Medical practice in Indonesia requires strict regulation to protect patients while providing legal certainty for medical personnel. This writing analyzes the licensing regulations for medical practice through the Registration Certificate (STR) and the Practice License (SIP) based on Law Number 17 of 2023 concerning Health, as well as examines criminal sanctions for doctors practicing without a license. The discussion also covers the role of the Professional Discipline Council as a filter in law enforcement with a settlement deadline of 14 working days, the function of the Indonesian Medical Council in the registration and guidance of doctor competence, as well as legal protection for patients and medical personnel in medical disputes through three settlement channels, namely mediation, the professional discipline council, and the court. The results of the discussion show that compliance with the STR and SIP is not merely an administrative formality but a legal necessity that protects both parties, with the threat of imprisonment for a maximum of five years or a fine of up to Rp500,000,000 for violators.
