Validity of Special Power of Attorney and its Legal Consequences in Industrial Relations Dispute Proceedings

This study analyzes the criteria and validity requirements of a special power of attorney in industrial relations dispute cases based on the procedural law applicable in Indonesia, as well as the legal implications for a power of attorney that does not meet formal requirements. A normative juridical approach is utilized through literature study of primary, secondary, and tertiary legal materials. The results of the study indicate that a special power of attorney must meet formal requirements consisting of specificity, designation of the competent court, identity of the parties, subject matter of the dispute, authority of the attorney-in-fact, date of issuance, and stamp duty. If these requirements are not met, the legal counsel loses legal standing, the lawsuit may be declared inadmissible, and all legal actions become invalid. The implications include delayed case resolution, increased costs, and reduced effectiveness of the principle of fast, simple, and low-cost justice. A good understanding by the parties and legal counsel regarding the formal requirements of a special power of attorney is necessary.
